Cloanto selling demoscene productions...

What's the deal with a package like this?:
http://www.c64forever.com

"More than 200 preinstalled games and demoscene productions"

I don' think they are allowed to sell demoscene productions, are they? Or have they cleared it with their authors?

Unless you released your demo with a license agreement, it's fair to assume that it's free to distribute. Of course it would have been nice if Cloanto asked before bundling it with a commercial product, but I don't think they've broken any laws.

AFAIK Cloanto "anticipated" C64Forever package contents on december 2008 and distributors websites since february. What's the point today?

Don't take it personally but I like to see that someone spread scene productions.

;)

No, I don't take it personally, of course none of my stuff is in there, 'm a n00b ;p but I know that CLoanto have before distributed games for the Amiga without a license and I don't like seeing them do the same with the c64, specially with the demoscene which I truly love.

I understand that demo distribution is assumed as free, but I think that any commercial reproduction/duplication should be cleared with the authors.

how did the mindcandy DVDs handle it?

Actually there is quite a lot of other products which seems on the "razor's edge" from my personal point of view.
Scene productions, by nature, needs to be spread all over the net (unless otherwise stated, obviously) while other things needs license agreements and such, If you may have come concerns about any kind of abuse simply report them to Cloanto directly...

i guess, we should assume that cloanto charges only for the shipping and user interface. the c64 content is not involved in the price ;)

Quoting Akira K

how did the mindcandy DVDs handle it?

By asking all authors for permission.

I'm not sure how licence/copyleft stuff works in this case, Cloanto is asking money for the package, but they provide alternatives, links to this db etc.

Person should have contacted the copyright owners. Surely the C64 productions could have been distributed in a way that doesn't require payment instead of putting them in to the package. That way it can be sure the payment is only for the software they make/licenced and sell.

Even if they could't get permission at least make it obvious they are trying to.

I dunno, this is as st0pid as selling CDs with music or such stuff. It's already there and it's free. ..but then, you can't really help people from bying stuff that is already free.

I just want to inform you that Cloanto did ask TRIAD for permission to include some of our demos in the package. We gave them that permission. Ofcourse, I can't speak for anyone else, but probably they asked others too.

There is no legal way to stop it as we see it, but we appreciate that they indeed did ask. As long as our demos and productions are available for free and easily accessible on the net, we don't mind if it's included in some package sold by Cloanto aswell.
